Terms of Use

1. Acceptance of Terms

By accessing the SOS Bouffe mobile application or the sosbouffe.net website (the "Service"), you agree to be bound by these Terms of Use. If you do not accept these terms, you may not use the Service. These terms constitute a binding contract between you and InnoLogiciel Inc.

2. Description of Service

SOS Bouffe is a food pre-ordering platform that allows consumers to reserve gourmet baskets from local merchants in Quebec. The Service is offered as Software-as-a-Service (SaaS) through the InnoBooks platform. We reserve the right to modify, suspend or discontinue certain features without notice, at our sole discretion.

3. Service Area

The Service is currently available exclusively in Quebec, Canada. Use of the Service outside this geographic area is not supported.

4. User Accounts

You must provide accurate information when creating your account and keep this information up to date. You are responsible for securing your login credentials. Use of the Service for illegal purposes is strictly prohibited. There is no minimum age requirement to use the Service.

5. Subscriptions and Pricing (Merchants)

Use of the Service for merchants is subject to InnoBooks platform subscription plans:

Payments are processed monthly via Stripe. No refunds are provided, except as required by law. In case of payment failure, Stripe will make up to three attempts. Accounts in default may be suspended. Pricing changes will be communicated in advance.

6. Free Trials

Trial periods and promotional offers may be available. We reserve the right to set conditions and withdraw them without notice.

7. Data and Privacy

Your personal information is processed in accordance with our Privacy Policy. Data is hosted by OVH in Canada. Payments are processed by Stripe.

8. License

We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Any reproduction, resale, copying or misuse of the Service is prohibited.

9. Intellectual Property

The software, including its code, interfaces, logos and documentation, remains the exclusive property of InnoLogiciel Inc. Use of the Service does not confer any intellectual property rights.

10. Orders and Transactions

  • Orders are confirmed once accepted by the merchant
  • Cancellation is only possible if the merchant has not started preparation
  • You have 30 minutes after receipt to report a missing or incorrect item
  • Displayed prices are set by merchants and may vary
  • Applicable taxes are calculated automatically based on jurisdiction

11. Technical Support

Technical assistance is provided via email at fredericcoutu@innologiciel.com with a reasonable response time, without guaranteed resolution timeframes.

12. Limitation of Liability

The Service is provided "as is" and "as available." We do not guarantee the accuracy, reliability or continuous availability of the Service. InnoLogiciel Inc. shall not be held liable for:

  • Errors in orders or amounts
  • Quality of products provided by merchants
  • Service interruptions
  • Third-party service failures (Stripe, hosting)
  • Any data loss beyond reasonable security measures in place

13. Indemnification

You agree to defend and indemnify InnoLogiciel Inc. against any claims arising from your use of the Service.

14. Termination

You may terminate your account at any time. We may suspend or terminate your account without notice for violations, abuse or non-payment. Upon termination, your access ceases and your data may be deleted subject to legal retention obligations.

15. Changes

We may update these terms periodically. The current version is always available on this page. Continued use of the Service after publication of changes constitutes acceptance of the new Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute shall be submitted to the competent courts of the judicial district of Drummondville, Quebec.

17. General Provisions

If any clause of these Terms is found to be invalid, the remaining provisions shall remain in effect. Failure to exercise a right does not constitute a waiver of that right.
